#Hungary can’t demand proof of gender assignment to correct an Iranian #refugee’s #gender status, the #EuropeanUnion’s top court ruled today.
The ECJ ruled that an EU Member State "may under no circumstances make the exercise of the right to rectify incorrect #personaldata subject to the production of evidence of sex reassignment surgery," as it would undermine the "essence of the right to the integrity of the person and the right to respect for private life" [1/2]
The court also said that #gender identity is “one of the most intimate aspects” of private life," adding that #transgender people have a right to “personal development and to physical and moral integrity, as well as to respect for and recognition of their gender identity.”
