The Sixth Circuit’s Chief Judge Sutton gives a great lesson in opinion writing in a dispute over oil and gas leases. He lays out the complex structure of the transaction and gives a clinic in interpretation — all in twelve pages!

Reading about Wisconsin's successful 2023 efforts to narrow the scope of who has legal standing to sue to block residential development to those who can prove actual (not "de minimus") harm. Connecticut to my knowledge has not done this nor has Virginia. I suspect none of the 20 states with additional rezoning protest provision language have either. I'm not sure about the rest https://docs.legis.wisconsin.gov/2023/proposals/reg/asm/bill/ab266 #zoning #litigation #housing

Possible useful teaching case on the new business rule (and why we don’t need it). District Court reverses $100 million verdict, not b/c of the new business rule but because damages just weren’t provable with reasonable certainty.

Quarter of heatwaves this century 'virtually impossible' without climate change, study finds
"If the occurrence of fires, cyclones or droughts can be directly linked to emitters, damage caused by those disasters may be easier to litigate than heatwave-related damages. The scientific community has been working for years now towards end-to-end attributions, linking anthropogenic actors to impacts. Not just temperatures, but economic losses, casualties."
