tomate<p><strong>Das Zählpixel der VG WORT</strong></p><p><span class=""><span class="">Lesedauer</span> <span class=""> 4</span> <span class="">Minuten</span></span></p><p>Autor*innen stehen Anteile der Urheberrechtsabgaben zu, wenn sie frei kopierbare Texte veröffentlichen. Diese Abgaben führen alle Menschen ab die in Deutschland z.B. ein Tablet oder ein Smartphone kaufen, einen Scanner oder eine Festplatte, denn alle diese Geräte sind in der Lage, frei kopierbare Texte zu kopieren. Dabei ist es unerheblich, ob der Text hinter einer Paywall ist oder nicht – er darf nur nicht kopiergeschützt sein. Aber wie funktioniert das denn mit Texten im Internet?</p><p></p><p>Für Texte im Internet hat die VG WORT METIS entwickelt. METIS steht für „Meldesystem für Texte auf Internetseiten“ und funktioniert so, dass auf jeder Seite auf der eigenen Website mit genug Text (1800 Zeichen) von den Urhebern eine sogenannte Zählmarke eingesetzt wird. Wenn ich z.B. in der taz etwas veröffentliche gebe ich dem Zuständigen Redakteur meine Karteinummer und am Ende des Jahres wird der Text von der taz an die VG WORT gemeldet und ihr dabei mitgeteilt, dass ich der Urheber bin und die Urheberrechtsabgaben mir zustehen (Mittlerweile haben die Verlage genug Lobbyarbeit geleistet, so dass der Bundestag gesetzlich festgehalten hat, das Verlage an den Urheberrechtsabgaben zu beteiligen sind.</p><p>Ich bin seit vielen Jahren grundsätzlich der Meinung, dass die VG WORT Autor*innen hasst aber Verlage liebt. Anders kann ich es mir nicht erklären, warum die VG WORT für die Verlage Partei ergriffen hat, so dass Urheber*innen weniger Geld bekommen. Oder warum in der „<a href="https://tom.vgwort.de/Documents/pdfs/dokumentation/metis/DOC_Verlagsmeldung.pdf" rel="nofollow noopener" target="_blank">Integrationsbeschreibung – METIS für Verlage</a>“ die Hinweise zum Datenschutz METIS betreffend aufgeführt sind, in dem Dokument „<a href="https://tom.vgwort.de/Documents/pdfs/dokumentation/metis/DOC_Urhebermeldung.pdf" rel="nofollow noopener" target="_blank">METIS für Urheber</a>“ allerdings nicht. Und wo ich gerade bei Datenschutz bin: Neulich freute ich mir sehr, dass die VG WORT nach vielen Jahren des Bittens und Bettelns endlich eine API für Autor*innen hat und sogar ein WordPress-Plugin bereit stellt, damit ich z.B. hier auf meinem Blog die Zählmarken endlich automagisch einem Artikel zuweisen kann und sogar alle relevanten Daten bezüglich der Meldung ebenso automagisch übertragen kann. Bitte klicke <a href="https://chaos.social/@tr4nt0r/111699925866380284/" rel="nofollow noopener" target="_blank">hier, um direkt dem externen Inhalt zu gelangen</a>.</p><p>Zuerst einmal muss ich die Frage so stellen, dass ich sie hier beantworten kann: „Wie moralisch verwerflich ist es, Autor*innen das ihnen zustehende Geld zu verwehren?“ Die VG WORT zahlt nicht einfach für jeden Text im Internet Geld. Es muss zwischen dem 01.01. und 31.12. eines jeden Jahres eine unbekannte Anzahl uniquer Hits aus Deutschland stattfinden, um für den Geld irgendwas um die 25 EUR zu bekommen. Es geht also nicht um viel Geld, aber es kann sich im Jahr schon summieren. Ich habe letztes Jahr knapp 400 EUR über VG WORT gemeldet Texte im Internet erhalten. Texte auf Seiten ohne Textmarken kann ich ebenfalls melden, sie werden aber anders vergütet und sind bei der vorherigen Zahl nicht dabei. Texte auf einer eigenen Website <em>müssen</em> eine Textmarke haben, um vergütet zu werden.</p><p>Aber zurück zum Problem: Wie viel Tracking ist das denn, was da beim Zählen der VG WORT passiert? Natürlich hat die VG WORT das mal aufgeschrieben und zwar in oben bereits erwähnten Integrationsbeschreibung für Verlage auf Seite 9:</p><blockquote><p><strong>Textbaustein für Ihre Datenschutzerklärung<br></strong>Wir setzen die METIS-Zugriffszählung der VG WORT zur Messung von Zugriffen auf Online-Texte ein,<br>die wir Ihnen über unser Angebot zur Verfügung stellen. Dies tun wir, damit die<br>Kopierwahrscheinlichkeit dieser Texte erfasst werden kann. Die Kopierwahrscheinlichkeit eines Textes<br>bildet die Grundlage einer rechtmäßigen Ausschüttung von Vergütungen nach dem<br>Urheberrechtsgesetz (UrhG) seitens der VG WORT an die Urheber und Verlage dieser Texte.<br>Dazu wird im Rahmen der METIS-Zugriffszählung eine „Zählmarke“ in den Quellcode des jeweiligen<br>Online-Textes eingebunden. Diese Zählmarke ist eine eindeutig diesem jeweiligen Text zugeordnete<br>ID und führt dazu, dass beim Besuch eines so gekennzeichneten Textes ein Zugriff auf diesen Text<br>gezählt werden kann. Darüber hinaus wird im Rahmen der METIS-Zugriffszählung eine Client-ID<br>gebildet und ein sog. „METIS Session Cookie“ beim Nutzer des markierten Textes gesetzt. Mittels<br>dieser Client-ID und des Session Cookie kann erkannt werden, ob innerhalb einer Browser-Session<br>der Text von diesem Nutzer bereits aufgerufen wurde oder nicht. Damit sollen unrechtmäßige<br>Mehrfachzählungen dieses Textes im Rahmen der Bestimmung seiner Kopierwahrscheinlichkeit<br>vermieden werden. Weder durch das ausgespielte Session-Cookie noch sonst zu irgendeinem<br>Zeitpunkt im Rahmen der METIS-Zugriffszählung werden personenbezogene Daten verarbeitet.<br>Die METIS-Zugriffszählung wird für die VG WORT von der Kantar GmbH, Landsberger Straße 284,<br>80687 München durchgeführt.<br>Zu keinem Zeitpunkt werden einzelne Nutzer identifiziert. Ihre Identität bleibt immer geschützt. Keine mit denen sie irgendwie mehr machen kann, als zu zählen, wie oft jemand einen Text in einer Browser-Session aufgerufen hat und jede Zahl größer als 1 wegwerfen. Jedes Jahr legt die VG WORT die Schwelle ab der es Geld für einen Texte gibt neu fest. Und so blöd das jetzt klingt: Jeder nicht gezählte Zugriff auf einen Text hier auf meinem Blog sorgt dafür, dass ich nächstes Jahr von dem großen Kuchen Urheberrechtsabgaben weniger abbekomme – und so geht es auch allen anderen Autor*innen, die vor allem auf ihrer eigenen Seite veröffentlichen. Die Zählpixel laufen übrigens über <code>*.met.vgwort.de</code> – das müsst ihr bei den meisten Blockern manuell in die Whitelist eintragen.</p><p>Ist es moralisch verwerflich, das VG WORT Cookie und Zugriffe direkt zu blocken? Ich finde ja aber wie immer können anderer Menschen das anders sehen.
