Judge Chen said #KristiNoem's actions appear to have been predicated on "negative stereotypes" by insinuating the migrants were criminals. The #Trump admin today, May 1, asked #SCOTUS to allow it to strip temporary protected status [#TPS] from >300,000 #Venezuelan migrants, a move that would clear the way for their #deportation. The #DOJ asked the justices to put on hold US District Judge Edward Chen's order that halted #DHS Secy #KristiNoem's decision to terminate the temporary #legal status that previously was granted to some #Venezuelans by President Joe #Biden's admin.

#SCOTUS’ unsigned, one-paragraph order came after a fast-moving legal battle late Friday. The #ACLU had rushed to several lower courts, then to the Supreme Court, claiming that the #Trump admin was planning to deport more #Venezuelan migrants, presumably to #ElSalvador, with little to no #DueProcess under the wartime #law, the #AlienEnemiesAct.

The Supreme Court’s decision ordered a pause on the #deportations of the detainees while it considers the emergency application.

But then on Friday, other #Venezuelan immigrants at the detention center were informed that they were facing imminent #deportation, court papers say. One of them, known as F.G.M., was instructed to sign a removal waiver in English, even though he speaks only Spanish.

When he refused to sign, #immigration officers told him the waiver was “coming from the president,” according to court papers, “and that he will be deported even if he did not sign it.”

This latest iteration of the fight over the use of the #AlienEnemiesAct began on Wednesday when the #ACLU filed suit in Abilene on behalf of 2 #Venezuelan immigrants being held at the Bluebonnet facility, asking Judge Hendrix to shield them against #deportation. But the judge denied the request, largely because lawyers for the #DOJ told him that the men — known only by their initials, A.A.R.P. & W.M.M. — had not yet been scheduled for removal from the country.

Drew C. Ensign, a lawyer for the #DOJ, gave his word that no flights were scheduled to depart from the Bluebonnet center on Friday night or Saturday morning, adding that the immigrants there would be given at least 24 hrs’ notice before they were deported.

But Judge #Boasberg was skeptical of Ensign’s assertion, pointing out that the notice forms the #Trump admin had given to the #Venezuelan men did not contain an explicit statement that they were able to challenge their #deportations.

When Judge Hendrix did not grant their request quickly — & later rejected it entirely — the #ACLU lawyers filed a similar request to the US Court of Appeals for the #FifthCircuit in New Orleans.

The lawyers then filed an emergency petition to #SCOTUS, asking the justices to step in & issue an immediate pause on any #deportations because many of the #Venezuelan men had “already been loaded on to buses, presumably headed to the airport.”

#ACLU attys started w/an emergency filing in Federal Dist Court in Abilene, #Texas, in which they claimed that officers at the Bluebonnet Detention Center in Anson had started distributing notices to #Venezuelan immigrants informing them that they could face #deportation as soon as Fri night.
They asked Judge Hendrix, who is overseeing the case, to issue an immediate order protecting all immigrants in the Northern District of TX who might face deportation under the #AlienEnemiesAct.

#SCOTUS temporarily blocked the #Trump admin early Saturday from deporting another group of #Venezuelan immigrants accused of being gang members under the expansive powers of a rarely invoked wartime #law, the #AlienEnemiesAct.

“The government is directed not to remove any member of the putative class of detainees from the United States until further order of this court,” the court said in a brief, unsigned order that gave no reasoning, as is typical in emergency cases.

A federal appeals court in Washington put off for the moment a plan by Judge #Boasberg to open #contempt proceedings to determine whether the #Trump admin violated an order he issued last month stopping flights of #Venezuelan immigrants from being sent to #ElSalvador. The United States Court of Appeals for DC said it was entering what is known as an administrative stay to have more time to consider the validity of Judge Boasberg’s proposal.

"Erik Prince, the former CEO of #Blackwater USA and a Michigan native, is among a group of defense contractors proposing to expand plans for deporting #immigrants to a prison in El Salvador, Politico reported.

"The pitch would attempt to avoid #legal challenges by designating part of the El Salvador prison system as #AmericanTerritory, the report stated.

" 'It’s unclear how seriously the White House is considering the plan by Prince, who has drawn scrutiny for his firm’s role in a deadly massacre in Iraq two decades ago,' the Politico report stated. 'But it would give Prince’s group an unprecedented and potentially highly lucrative role in an expanded version of a transnational operation that has elicited its own web of controversies, in part because it has swept up immigrants who do not have criminal records in the United States.'

"The report coincides with President Donald Trump’s plans to host #NayibBukele, the president of El Salvador, at the White House on Monday, April 14.

"Since March, El Salvador has accepted from the U.S. more than 200 #Venezuelan immigrants — whom officials with President Donald Trump’s administration have accused of gang activity and violent crimes — and placed them inside the country’s notorious maximum-security gang prison. It is also holding a Maryland man who the administration admits was wrongly deported but has not been returned to the U.S., despite court orders to do so.

"Trump has ties to the family of Prince, an automotive supplier heir from Holland. Prince is the brother of #BetsyDeVos, the secretary of education during the first Trump administration.

"Prince, a major Republican donor, has been accused of acting as a back channel on behalf of Trump. As Trump was preparing to take office in 2017, Prince met with a official close to Russian President Vladimir #Putin in the #Seychelles, islands off the coast of east Africa. Special counsel Robert Mueller’s report on his Russia investigation said the meeting was set up ahead of time with the knowledge of former White House aide #StephenBannon.

"Prince soared to notoriety after Blackwater USA employees in 2007 shot and killed #Iraqi #civilians in Baghdad’s #NisourSquare during the Iraq war, casting a light on the role played by private contractors in U.S. military operations overseas.

"In the wake of the scandal the company’s name was changed and Prince sold his shares to a private equity fund."
