I've been quite critical of #SCOTUS for not taking the equities seriously in granting/denying emergency relief. A common rejoinder from the Court's defenders is that it is "just" doing preliminary merits adjudications now. And yet, here's Kavanaugh saying "the equities still matter ... sometimes."

#SCOTUS *denies* emergency application from NetChoice seeking to put Mississippi's age-verification-for-social-media law back on hold. Kavanaugh concurs, noting that NetChoice is likely to prevail on the merits, but that he's denying relief anyway because of the equities (which he doesn't address):

#SCOTUS would have a much easier job convincing people that it was taking the balancing of the equities seriously in granting/denying emergency relief if anyone in the majority in any of these cases ever bothered to actually explain *how* they were balancing the equities. Not so much here.

I think many would agree that today we find ourselves in a situation where many things we hold dear and thought were settled over the past 75 or even 100 years are now under attack and threatened to be dismantled. I think about me as a person with disabilities. Many employment opportunities available through #DEI programs are now gone. Disability rights in general are being weakened because we need to bow to the needs and wants of business. And then there’s #SCOTUS nuking #Roe and almost certainly setting their sites on #SameSexMarriage next. And why stop there? Why not get rid of #Miranda and #Gideon while they’re at it? Perhaps even #Loving to boot? And also decide that maybe the #Confederacy was victorious after all? I think I’m in need of lunch and possibly an attitude adjustment.

"#DOJ absurdly says:🚨there's no reason to stop its #RacialProfiling program bc racially profiled indivs can sue for damages for wrongful CBP/ #ICE detentions -lying! +its citation doesn't remotely dem it. CBP/ICE acts with near-total impunity.

#SCOTUS repeatedly: there're no damages for BP agents' uncon conduct. A CBP agent beat up a small bus owner at his bus, not crossing the border said: it'd COMPROMISE NAT SEC to let him sue the agent who illegally beat him up..."

The decision cleared the way for teams put in place this year by #Musk to reclaim “high-level IT access” to govt databases, Judge Julius Richardson wrote, over the objections of a number of #labor #unions who had sued, arguing the move violated federal #privacy laws.

…Richardson said the…case mirrored those in a lawsuit involving #data that #SCOTUS weighed as an #emergency application….In that case, SCOTUS…allowed #DOGE to continue sifting through the records “in order…to do their work.”

A federal appeals court on Tuesday allowed teams affiliated with #DOGE to gain #access to potentially sensitive #data on millions of Americans, overruling a lower court that had blocked that access in Feb.

By a 2-1 vote, a 3-judge panel of the US Court of Appeals for the #FourthCircuit granted the access to data stored at the #Treasury Dept, the #Education Dept & the Office of Personnel Management [#OPM], citing the June #SocialSecurity #SCOTUS decision.
